{"id":69215,"date":"2017-12-12T10:16:41","date_gmt":"2017-12-12T09:16:41","guid":{"rendered":"https:\/\/tcm.be\/glossarium\/writ-of-execution\/"},"modified":"2026-01-14T23:23:35","modified_gmt":"2026-01-14T22:23:35","slug":"writ-of-execution","status":"publish","type":"glossarium","link":"https:\/\/tcm.be\/en\/glossarium-en\/writ-of-execution\/","title":{"rendered":"Writ of execution"},"content":{"rendered":"\n<p>A <strong>writ of execution<\/strong> is a legal document containing the order for execution, which officially certifies the existence of a liquid and matured <a href=\"https:\/\/tcm.be\/en\/receivable\/\">claim<\/a> . It also enables the holder to obtain execution of the claim and authorises a <a href=\"https:\/\/tcm.be\/en\/bailiff\/\">bailiff<\/a> to proceed with what is called <strong>compulsory execution<\/strong> (in case of the debtor\u2019s inaction faced with this order).<br><br>For <strong>debt collection<\/strong> , when a <a href=\"https:\/\/tcm.be\/en\/debtor-definition\/\">debtor<\/a> owes money to their <a href=\"https:\/\/tcm.be\/schuldeiser\/\">creditor<\/a> and they have not settled it voluntarily, the <strong>writ of execution<\/strong> , obtained from a court, will establish with certainty the existence of the <a href=\"https:\/\/tcm.be\/en\/debt\/\">debt<\/a>, the amount due, as well as the person who is accountable for it.<br><br>There are three types of <strong>writs of executions<\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Judgements<\/li>\n\n\n\n<li>Administrative constraints<\/li>\n\n\n\n<li>Notarial deeds<\/li>\n<\/ul>\n\n\n\n<p>Definitions provided under this section refer to the Belgian situation; unless specified otherwise.
