{"id":69255,"date":"2018-07-03T13:48:40","date_gmt":"2018-07-03T11:48:40","guid":{"rendered":"https:\/\/tcm.be\/glossarium\/judicial-recovery\/"},"modified":"2026-01-14T23:13:31","modified_gmt":"2026-01-14T22:13:31","slug":"judicial-recovery","status":"publish","type":"glossarium","link":"https:\/\/tcm.be\/en\/glossarium-en\/judicial-recovery\/","title":{"rendered":"Judicial recovery"},"content":{"rendered":"\n<p><strong>Judicial recovery<\/strong> is a legal process that consists of referring an unpaid debt to a competent court in order to recover it.<br><br>Generally speaking, the <strong>creditor<\/strong> will initially seek to recover the amount owed to them without <strong>judicial<\/strong> proceedings. It\u2019s generally only after these attempts at <a href=\"https:\/\/tcm.be\/en\/amicable-recovery\/\">amicable recovery<\/a><\/p>\n\n\n\n<p>(reminders, formal notification, visit, etc.) fail to bear fruit that the <strong>creditor<\/strong> instigates <strong>legal action<\/strong>.<br><br>The <strong>court <\/strong>concerned (commercial court, magistrates\u2019 court\u2026) will differ according to the nature of the <strong>negligent debtor<\/strong> . If it\u2019s a business subject to VAT, it is the <strong>commercial court <\/strong>that should be applied to, whereas if the debtor\u2019s a natural person, application should, in most standard cases, be made to a <strong>magistrates\u2019 court<\/strong> for <strong>debts of less than \u20ac2,500<\/strong> (magistrates\u2019 courts possess special or exclusive powers in relation to leases or orders of payment under \u20ac1,860), or to the <strong>court of appeal<\/strong> for other matters. It is a <a href=\"https:\/\/tcm.be\/en\/bailiff\/\">bailiff<\/a> who will then deliver a <strong> summons<\/strong> to the debtor, which means that the latter has been officially informed that the creditor has gone to court in order to obtain payment of the amount owed to them.<br><br>By referring the matter to a court, the <strong>creditor <\/strong>will also be seeking to obtain a <a href=\"https:\/\/tcm.be\/en\/writ-of-execution\/\">writ of execution<\/a> so that the existence of the debt, the debtor and the amount owed are established with certainty.<\/p>\n\n\n\n<p>Definitions provided under this section refer to the Belgian situation; unless specified otherwise.
