{"id":69264,"date":"2018-07-30T10:15:14","date_gmt":"2018-07-30T08:15:14","guid":{"rendered":"https:\/\/tcm.be\/glossarium\/pledges\/"},"modified":"2026-01-14T23:10:30","modified_gmt":"2026-01-14T22:10:30","slug":"pledges","status":"publish","type":"glossarium","link":"https:\/\/tcm.be\/en\/glossarium-en\/pledges\/","title":{"rendered":"Pledges"},"content":{"rendered":"\n<p>A <strong>pledge<\/strong> is a contractual <strong>guarantee<\/strong> whereby the <a href=\"https:\/\/tcm.be\/en\/debtor-definition\/\">debtor<\/a> is dispossessed of one of its assets in favour of the <a href=\"https:\/\/tcm.be\/en\/creditor-definition\/\">creditor<\/a> in order to <strong>guarantee their debt<\/strong> . When the asset consists of <strong>moveable goods<\/strong> , it is referred to as a <strong>pledge<\/strong> . When the asset is <strong>immoveable<\/strong>, it is called an <strong>antichresis<\/strong> (replaced by <strong>mortgage <\/strong>as it does not involve the seizure of the asset by the debtor). There also exists a <strong>non-possessory pledge<\/strong> on a business\u2019s goodwill. This <strong>pledge<\/strong> covers all of the <strong>tangible and intangible assets<\/strong> that make up this goodwill.<br><br>Updated 30\/07\/2018<\/p>\n\n\n\n<p>Definitions provided under this section refer to the Belgian situation; unless specified otherwise.
