{"id":69280,"date":"2018-10-15T09:56:09","date_gmt":"2018-10-15T07:56:09","guid":{"rendered":"https:\/\/tcm.be\/glossarium\/consular-judge\/"},"modified":"2026-01-14T23:06:17","modified_gmt":"2026-01-14T22:06:17","slug":"consular-judge","status":"publish","type":"glossarium","link":"https:\/\/tcm.be\/en\/glossarium-en\/consular-judge\/","title":{"rendered":"Consular judge"},"content":{"rendered":"\n<p>The <strong>consular<\/strong> <strong>judge<\/strong> is a judge who is not a professional judge and who sits in the <a href=\"https:\/\/tcm.be\/en\/commercial-court\/\">Commercial Court<\/a> next to a professional judge.<br><br>The <strong>consular judges<\/strong> have the particularity of not being judges by profession. In fact, they come from <strong>commercial and\/or financial enterprises<\/strong> . As a general rule, they are <strong>appointed<\/strong> for a <strong>period of five years <\/strong>by the <strong>King<\/strong> , on the joint proposal of the Ministers for Justice, Economic Affairs, and SMEs and the Self-Employed.<br><br>The <strong>consular judges<\/strong> are appointed to assist the professional judges by contributing their knowledge of the economy. Each Chamber of the <strong>Commercial Court<\/strong> is, moreover, made up of a professional judge and two consular judges. The vote of the consular judges is accorded as much importance and weight as that of the professional judge hearing a case. Decisions are thus taken by consensus. If it should so happen that consensus is not reached, the rule of simple majority is observed.
