It\u2019s designed to better protect the<strong>privacy<\/strong>of<strong>European citizens<\/strong>, but what are its implications for<a href=\"https:\/\/tcm.be\/en\/debt-recovery-company\/\"><strong>debt recovery companies<\/strong><\/a>?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Before the GDPR<\/h2>\n\n\n\n<p><strong>Belgian debt recovery companies<\/strong>and members of<a href=\"https:\/\/www.abrbvi.be\/fr\/the-belgian-collectors-association\/\" target=\"_blank\" rel=\"noopener\">the ABR-BVI<\/a>like<a href=\"https:\/\/tcm.be\/en\/debt-recovery-company\/\">TCM<\/a>were bound not only by the Law of 8 December 1992 on the protection of privacy, but also by the code of ethics of this association as well as the<a href=\"http:\/\/www.fenca.org\/\" target=\"_blank\" rel=\"noopener\">FENCA<\/a>code.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">As of 25 May 2018<\/h2>\n\n\n\n<p>In fact, there will be no major changes to the way we operate. We will need to continue to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n\n<li>Only process<strong>data useful<\/strong>for our work (e.g. name and address)<\/li>\n\n\n<li>Not process or save<strong>sensitive data<\/strong>which is<strong>unnecessary<\/strong>for our work (e.g. information on political or religious views or regarding ethnicity or health)<\/li>\n\n\n<li><strong>Ensure that the processing of this data is secure<\/strong>, i.e. not accessible by unauthorised persons. In this regard,<strong>TCM<\/strong>uses secure<a href=\"https:\/\/tcm.be\/en\/about-tcm\/data-processing\/\">systems<\/a>and<a href=\"https:\/\/tcm.be\/en\/online-clients-access\/\">secure<\/a>transfer methods<\/li>\n\n\n<li>Not sell or pass on this data unless it\u2019s necessary for our work or if we\u2019re obliged to do so by law<\/li>\n\n\n<li>Inform individuals who request the data we have on them and<strong>correct or delete this data<\/strong>when required<\/li>\n\n\n<li>Not unnecessarily retain data on a person after their<strong>debts<\/strong>have been settled.<\/li>\n\n<\/ul>\n\n\n\n<p>As of 25 May 2018, two new elements are being added to the legal requirements:<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Carrying out an impact analysis for risky processing activities<\/h2>\n\n\n\n<p>If a planned<strong>processing operation involving personal data<\/strong>presents a high risk to the rights and freedoms of natural persons, we will be required to carry out an impact analysis. This applies to IT development in particular. In fact, at<strong>TCM<\/strong>, we\u2019ve always taken the protection of personal data into account for this type of processing, so this new legal requirement is already second nature to us.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Appointing a data protection officer<\/h2>\n\n\n\n<p>A company such as ours that processes huge amounts of<strong>personal data<\/strong>will be required to designate a<strong>data protection officer<\/strong>who will serve as the company\u2019s contact for the data protection authorities. They will also be responsible for informing and advising on data and controlling its flow within the company.<strong>TCM<\/strong>has designated its CEO, Etienne van der Vaeren, for this role, for the time being and until this task is taken care of by someone else.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The ABR-BVI code<\/h2>\n\n\n\n<p>Our professional body, the<strong>ABR-BVI<\/strong>, has modified its ethical code and added a new code of \u2018<a href=\"https:\/\/www.abrbvi.be\/fr\/the-belgian-collectors-association\/\" target=\"_blank\" rel=\"noopener\">Minimum standards for privacy protection policies<\/a>\u2019 in order to reflect the new legislation. Of course,<strong>TCM<\/strong>observes this code.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Conclusion<\/h2>\n\n\n\n<p>We\u2019re ready for 25 May 2018 and are already applying the<a href=\"https:\/\/tcm.be\/en\/company\/compliance-info\/#GDPRen\">new standards<\/a>.
