Right of retention
Glossary
Right of retention is the right of a creditor to retain possession of an item until the debtor has paid the outstanding debt. This right only applies to goods that are related to the claim and that are in the creditor’s possession. It serves as a practical pressure tool in collection situations but is subject to legal limitations and must be applied proportionally.
