Unfair contract terms

An unfair clause is a contractual provision that creates a clear imbalance between the rights and obligations of the parties, to the detriment of one of them. The law provides a black list of clauses that are always prohibited and a grey list of clauses presumed to be unfair. Such clauses are null and void, meaning they have no legal effect, but the remainder of the contract remains validEen onrechtmatig beding is een contractuele clausule die een kennelijk onevenwicht schept tussen de rechten en plichten van partijen, waardoor één partij juridisch benadeeld wordt. De wet voorziet een zwarte lijst van altijd verboden bedingen en een grijze lijst van vermoedelijk onrechtmatige bedingen. Zulke bedingen zijn nietig, wat betekent dat ze geen rechtsgevolgen hebben, maar de rest van het contract blijft geldig.
